Show ORDINANCE GRANTING TO LORAN L. LAUGHLIN. HIS SUCCESSORS AND ASSIGNS A GAS FRANCHISE FRAN-CHISE FOR ALL USEFUL PUR POSES. THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF IRON ORDAINS AS FOLLOWS: SECTION 1. That there Is hereby here-by granted to I OR AN L. LAUGHLIN, LAUGH-LIN, his successes and assigns, hereinafter called the grantee, the right, privilege, or franchise, for the period of twenty years from and after the passage of this Ordinance, to lay, construct, operate and maintain gas mains, service pipes and lines, curb boxes box-es and other necessary attachments attach-ments and appliances below the surface of the ground In the present pres-ent and future roads, highways, alleys, lanes and public places In the County of Iron over which the Board of County Commissioners Commis-sioners has Jurisdiction, for the purpose of conveying, distributing, distribut-ing, supplying and selling gas to said county, the inhabitants thereof and property owners and, users therein, and to persons and corporations beyond the limits, thereof, for all useful purposes. SECTION 2. That before the grantee shall lay, construct or Install In-stall any gas mains or pipes under un-der this grant, he shall make written application to the Board of County Commissioners of Iron County for permission so to do, which application shall fully describe de-scribe the nature of the proposed Installation and shall set forth the street or streets upon which it is to be laid, and installation shall not be made until grantee receives from such Bard of Couny Commissioners permission therefor. The Board of County Commissioners shall designate! the exact location within thei streeti where any mains or pipes are to be laid. SECTION 3. That said grantee, his successors and assigns shall lay and conduct all gas mains and pipes under this grant with dispatch in accordance with established es-tablished practices with respect to gas line construction, and so as not to unnecessarily Interfere with water pipes or other pipes which may have been previously laid in said roads, highways, alleys, al-leys, lanes and public places having regard to the safety and convenience of said county and its citizens. SECTION 4. That all roads, hlgways, alleys, lanes and public pub-lic places that may be opened by the grantee for ine aforesaid purposes pur-poses shall ims f'.""1 in and put in as good repair as they were prior to the opening thereof and so as to present the least possible possi-ble obstruction and inconvenience inconven-ience to the traveling public. SECTION 5. That said county shall In no way be liable or responsible re-sponsible for any accident or damage da-mage that may occur in the construction, con-struction, operation or maintenance mainten-ance by the grantee of his pipelines pipe-lines and appurtenances hereunder, hereun-der, and the acceptance of this franchise shall be deemed an agreement on the part of said (grantee, his successors and assigns as-signs to indemnify said county and hold it harmless against any and all liability, loss, cost, damage dam-age or expense which may accrue ac-crue to said county by reason of any neglect, default, or misconduct miscon-duct of the grantee in the construction, con-struction, operation or maintenance mainten-ance of said pipe lines and appurtenances. ap-purtenances. That said grantee shall, within sixty (60) days after af-ter the passage of this ordinance, J accept in writing, duly filed with the County Clerk of Iron Couny, .this franchise and grants and privileges herein given, together with the conditions upon said granted binding. SECTION 7. This ordinance shall take effect on the 9th day of April, 1959, which date is not less than fifteen days after the passage of said ordinance.
