Show ORDINANCE NO. 1-68 AN ORDINANCE AMENDING AMEND-ING CHAPTER 13. MOAB CITY CODE. 1965 BE IT ORDAINED BY THE CITY COUNCIL OF THK CITY OF MOAB. UTAH: THAT Chapter 13 of the Moab City Code. 1965 be. and the same is hereby amended bv adding thereto Article III. Transient Merchants, which shall read in words and figures fig-ures as follows, to-wit: Article III. Transient Merchants Sec. 13-28. "Transient Merchant'' Mer-chant'' defined. For the purposes of this article, ar-ticle, a transient merchant is hereby defined to be any person or agent, servant or employee of any person who shall exhibit, sell or offer for for sale, at wholesale or retail, re-tail, any goods, wares, merchandise mer-chandise or foodstuffs in or from any hotel, rooming house, dwelling house, boarding board-ing house, store, store room, stall, tent, building, structure, struc-ture, stand, railroad car, motor mo-tor vehicle, or other place in the city, and who shall not occupy oc-cupy such place for the purpose pur-pose of conducting a permanent perm-anent business therein. The person so engaged shall not be relieved from the provisions provis-ions of this chapter by reason of association temporarily with any local dealer, trader, merchant or auctioneer or by conducting such temporary or transient business in connection connec-tion with or as a part of or in the name of any local denier, trader, merchant or auctioneer. auction-eer. Section 13-29. License required. requir-ed. It shall be unlawful for any person or for any agent, servant ser-vant or employee of any person per-son to engage in. carry on or conduct the business of a transient merchant in the city without first obtaining a license to do so. Section 13-30. Determination of issuance of license and fee by City Council. The issuance of the license lic-ense and the amount of the license fee for each transient merchant shall be determined determin-ed by the City Council at. the time of the application for license, li-cense, according to their discretion, dis-cretion, and according to tha type of business for which licensing is requested. Section 13-31. Sale of each article ar-ticle constitutes separate offense. of-fense. The sale of each article by any transient merchant without with-out a license therefor shall constitute a separate offense under this chapter. THAT except as hereinabove herein-above specifically amended Chapter 13, of the Moab City Code, 1965 shall remain in full force and effect. Passed by the unanimous vote of all members present of the City Council of the City of Moab, Utah, this 20lh day of February, 1968.
