Show U. S. Files Appeal Of Decision In Pelrillo Case CHICAGO, Dec. 27 (UP) The government prepared to go direct to the U. 8. supreme court Friday in its effort to convict James C. Petrillo, president of the American Ameri-can Federation of Musicians (AFL), of violation of the Lea act Notice of appeal was filed Thursday Thurs-day by Asst U. S. Atty. LeRoy Kreln against a ruling by Federal Judge Walter J. La Buy dismissing dismiss-ing the criminal action against Petrillo and declaring the act unconstitutional. un-constitutional. Kreln explained that the government gov-ernment planned to by-paas the U. S. circuit court of appeals and go directly to the supreme court because the case involved the question ques-tion of the consUtutinnallty of the law. The Lea, or so-called "antl-Pe-trillo," act prohibits employment of more persons in radio broadcasting broad-casting stations than the management manage-ment believes necessary to do the work required. |
