It Winnie Ruth Judd, condemned murderess is; mentally and physically unsound, it was charged today as motion Was made to strike out all her testimony at the preliminary hearing of J. J. Halloran, prominent Arixonan, accused ac-cused aa an accessory after murder. Tha contention was made by counsel coun-sel for Halloran, against whom Mrs. Judd Is the state's star witness. Mrs. Judd's attorneys unsuccessfully unsuccessful-ly pleaded Insanity for her when she waa tried, found guilty 'and condemned con-demned to death for tha slaying of Agnes Ann Lerol, her former close friend. The state accused Halloran of having hav-ing aided Mrs. Judd In tha deposition of Mrs. Larol's body and In tha flight she subsequently made to Los Angeles with tha body and tha body of Hed-vig Hed-vig Samuelaon, with whose murder Mrs. Judd also was charged, but which case never was tried. ' CONTINUOUS DELAYS The motion by Attorney Frank O. Smith came after a morning session of almost continuous delays while Mrs. Judd sat nervously on tha witness wit-ness stand waiting to resume her testimony. Smith's reference to "physical unsoundness" un-soundness" apparently referred to the known fact that Mrs. Judd suffers from tuberculosis. Judge J. C. Nile, conducting the preliminary hearing, promised a decision de-cision on tha motion at the opening of this afternoone session and he promptly adjourned court until then. Before he presented the motion, Smith questioned her minutely on the story she told yesterday of tha slaying slay-ing of tha two llrls. She put on a few hysterical demonstrations dem-onstrations as then, when she screamed, shouted, and sobbed out her replies, claiming, meantime, she shot them In self defense and that Halloran was responsbile for their deaths and her own Impending death on the gallows. Her answers, however, how-ever, were incoherent and one she turned fiercely on Smith. "How cloaa were you to Miss Samuelaon Sam-uelaon when she was shot?'' Smith ssked. Th rest of the cross examination went into detail on the shooting of Mrs. Leroi and Miss Ssmuelson at the conclusion of what Mra. Judd claimed was a quarrel over Halloran. It was almost completely repetition repeti-tion of that already given by her except ex-cept that her answers, frequently evaslv and incoherent contributing little. Smith' motion Included the charges that Mrs. Judd wilfully concealed material ma-terial facta, and consistently committed com-mitted perjury, did not know the nstur of the proceedings, wholly failed to comprehend her right and duties aa a witness, and that she waa entirely incompetent to testify because be-cause she was mentally and physlcal-ly physlcal-ly unsound. |
