The question ques-tion of whether bay rum U an intoxicating- bevcratto was aired in the district -ourt here this niomins before Judge O. U. Haum in the case of an allied boot-k'er, boot-k'er, who had been arrested for having a quantity of tho liquid in his possession. Attorneys for the defendant filed a demurrer de-murrer on the ground that the information informa-tion did not constitute an offeiiRe, in that the defendant was charged "with havln in hin possession Intoxicating liquor, to wit, bav rum." The court was thus called upon to di-finc the status of bay rum, inasmuch as the statutes do not classify it as Intoxicating liquor. Judge Biium In rendering his decision auHtalned the demurrer and the information informa-tion was quashed. Judge Baum's comment com-ment on the cae was that the information informa-tion should have specified that the bay rum was bein used for beverage purposes. |
