Show WILL TEST LEGALITY OF SEARCH CLAUSE The constitutionality of that portion of the prohibition law that provides for the search of premises without a warrant war-rant is to be tested in the case of F. S. tJtitt, a negro, charged with bootlegging. Attorney Samuel King, who represents Stitt, says that the police entered the bootblack stand of the alleged bootlegger at West Second South street several days ago, without a warrant, and confiscated confis-cated a revolver and other articles belonging be-longing to Stitt. Tuesday nighc plainclothes plain-clothes officers again raided the bootblack stand and arrested Stitt and seized $147.50 in cash. One bottle of whisky found in the place was smashed In a fight between the negro and Officer Stein. Stitt was released from the city jail last night on $300 bail. |
