Show PROPERTY OWNERS LOSERS IN ACTION May Take Ogden Paving Case to the Supreme Court of the Stat?. Special to The Tribune. OCrDEN. Sept. 19. Any further action bv the property owners or Twenty-eighth street and paving district No. 125 against the city commissioners must be taken in the supreme court of the state, according to a decision rendered by Judge A. E. Pratt in the Second district court when he denied a motion for a new trial. The petition of the property owners tor an Injunction restraining the city board and a contractor from proceeding with the paving in the district was recently denied by Judge Pratt. Arguments on the motion for a new trial of the case were made in the district court this morning. H. H. Henderson appearing for the petitioners and J. A. Howell and Cltv Attorney E. T. Hulanlsk! for the city board. After taking the matter under consideration Judge Pratt denied the motion mo-tion this afternoon. The protesting property prop-erty owners have not decided whether they will take their case to the supreme court. They charged that the city commissioners com-missioners gained jurisdiction for the paving by a technicality. |
