Under threat of "prosecution for contempt of court, ofrlclals of the Western Fuel company com-pany promised today to deliver the company's com-pany's books tomorrow to United States treasury agents who are conducting an Investigation under the direction of the federal grand jury. Tho government Is probing charges of alleged weighing frauds 'by which payment of tariff- on vast quantities of coal Imported within the laot six years was evaded. D. C. Morcross, secretary of the Western West-ern Fuel company, at first refused to produce tho books, and Informed District Attorney John L. McN'ab that It would require two drays to convey them to court. Twelve accountants, each a eub-treasury agent, will examine the books and others tvIU check books that have already al-ready been delivered to Special Agent Tldwell. A dock-weighing record was submitted to the grand Jury today and disclosed an entry vrhloh was questioned, in the light of the allegations regarding 8hort weighing of coal. "If the evidence Justifies it. every wolgher and every origlneer on the ships which received coal will be summoned before the grnjid Jury," said McN'ab, "If there are facts that do not warrant action ac-tion by the federal government, but that do warrajit action by the state, these facts will be turned over to the state authorities."
