Show K MARY E. MORRIS IN IBIS DAMAGES She Complains of Too Many Railroad Tracks Near Her Home. An interesting suit, which is ver3' similar io that of the Twenty-second ward corporation of tho Church of Jesus Christ of Latter-Day Saints against tho Oregon Short Lino Eaihvay company, tried and decided in favor of tho "plaintiff in Judge Ritchie-'s division di-vision of tho Third district court last week, is on trial before Judge Lewis of the Third district court this week. This case is that of Mary E. Morris against tho same compan' for damages alleged to havo been worked to the plaintiff's property on Third West street by the building by tho defendant defend-ant con'ipauy of live lines of track along it. Mrs. Morris Bays that theso lines of track, which are only a few feet from her property, will be used by both the San Pedro and tho Western Pacific railway companies and the running run-ning of from twentj'-fivo to fifty trains daiKy over them threatens to produce a tremendous noise and immense quantities quan-tities of smoke and prevent ingress and egress to her place. Tho property is worth .! 5,000. she sets out. and she is asking tho court for such relief as it may sec iiit to grant her. When tho defendant company obtained ob-tained tho franchise to lay the four additional ad-ditional tracks by her 'property, she says, it agreed to pay her proper damages dam-ages or buy the property outright, but has shown no intention of doing cither since. The Twont'-second ward corporation of tho Mormon church asked for $15,000 for damages to the. meeting house in that ward by tho noise and smoke from" passing trains and was awarded $4000. The cases are identical in the main. II. F. Evans, clerk in Judge- Lewis's court, was called out during the progress of tho trial and Miss Anna Salmon, an emploveo of the county clerk's, office, was summoned to act as clerk in Mr. Evans's stead. There was sonio trepidation trepida-tion on tho young woman's part for fear she might be called on to swear that is, to swear in a witness but her fears proved unnecessary, as no new witnesses were called during tho afternoon. |
