Show NOTED MURDER CASE IS NOW BEING TRIED Special to The Tribune. MAN'TI. Sept. 29. At 2 o'clock yesterday yester-day afternoon the case of tho stato versus Archibald Burns, charged with murder In tho first degroo, was called for trial In the district court here. It Is chaged that ' on March 21 Burns, while In an into.'l- ' cated condition, ishot and killed ono I James I'isk In a saloon at Mount Pleasant, Pleas-ant, following a quarrel between the two. Burns claims to havo shot FisU In self-defense. self-defense. Fifty jurors wero summoned, appeared In court and wero empaneled, but It Is thought that It will bo necessary neces-sary to summon additional jurors. The particulars of the troublo aro so widely known throughout Ihe county that It Is likely that much difficulty will be experienced ex-perienced In securing a Jury. At the time of adjourning yesterday the defonao had completed the examination of twelve Jurors, two of whom were, excused ex-cused on tho challenge of the defense. Tho remaining ten havo not yet been examined ex-amined by the prosecution. The case was resumed this morning. Today's session and possibly a good portion of tomorrow's will be taken up In tho examination of jurors. The case Is being tried by Judge J. F. Chldcster, from the sixth district, at tho request of Judge IDrlekson, who had a personal acquaintance with both Burns and Fisk. The stato is being represented by District Dis-trict Attorney Woods. County Attorney Larsen and S. Tl. ThUrman of Salt lakc City. Tho defense by W. II. King of Salt Lalio flty and James Cherry of Mount Pleasant. |
