Argument on the apppal of James Donaldson from the judgment of the Third district court, in entering a verdict ver-dict .for approximately $2500 in favor of William McWhirtcr as tho part of the $J 0,000 that Donaldson obtained in the robbery of tho MeWhirter brothers in tho Antler rooming house two years ago, was heard in tho supremo court Monday morning. At tho conclusion of tho argument tho case was submitted. Donaldson, who rccontly bqgan a tcn-yoar tcn-yoar sontenco at hard labor in tho stato prison for his part in the noted robbery, was not brought in to hear the argument. argu-ment. MeWhirter was awarded a verdict for approximately $2000 in the lower court, as the part Donaldson got of the $10,-000 $10,-000 stolen from him and his brother by Donaldson and four others, and Donaldson Don-aldson appealed tho case lo tho supremo court, llo was represented by Samuel K.
