Young and tho will of Julia Young Burton, both deceased, by Parkor B. Pratt, administrator admin-istrator of tho cstato of Alma Pratt, de-ceoscd. de-ceoscd. Tho. complaint, filed In the District Dis-trict court yesterday, alleges that Julia Young Burton was tho adopted daughter of Susannah S. Young and tho wife of Gen. Burton, Mrs. Burton died In 1SS9, about three ycare beforo Susannah Young, who In her will mode hor adopted child tho dovlseo of all hor household goods and chattels, together with ono-half of all tho residue of her CBtato. Tho dofondant was tho solo beneficiary of tho will of Julia Young Burton and tho executor of tho last will and ostato of Susannah S. Young. On April 6, 1S98. tho defendant is charged with having fllod a potltlon In the District court asking for a distribution of one-half of tho resluuo of tho estato of Susannah Young to Julia Burton, her hclrB, executors, execu-tors, legatees or assigns. Julia Young Burton Is alleged to havo boon doad moro than olght years previous to tho filing of tho petition, and the petition Is said to havo In no way disclosed her death, and that tho defendant did not claim to be hor heir or legatee, and that It was not shown that sho did not dlo without lineal Issue. Tho one-half of tho eatato in dlsputo Is valued at ?&39.70 oash, twenty shares of tho capital stock of tho Stato Bank of Utah, twonty-ono shares of tho capital stock of tho Z. C. M. I., four shnres of tho capltnl stock of tho Provo Woolon mlllB, ono share In tho Salt Lako Dramatic association, six shares Homo Flro Insuranco company and merchandise In Cutter Bros, company, 5- IC.SS. Tho defendant is alleged to havo received tho property and to havo refused upon demand de-mand to surrender the" samo. Tho complaint recites that Alma Pratt, deceased. Is ono of th? heirs of Susannah S. Young, and that hor will as regards Julia Burton was void for tho reason that she had died prior to tho death of tho decedent de-cedent Susannah Young. It la hold that the property of Susannah Young should bo distributed under the law to her heirs, somo of whom resldo in Wobcr county, somo In Salt Lake county and others outsldo of Utah. Tho plaintiff Is administrator of the estato es-tato or Alma Pratt, -who died In this city November 13, 1902, and who was son and heir-at-law of Hannott Snlvoly Pratt, deceased, de-ceased, who was a Bister of Susannah Snlvely Young. The plaintiff prays that the alleged do-grco do-grco allowing the tlnal accounts of the executor ex-ecutor be vacated and declared null and void as regards tho distribution of half of tho estate. The distribution of the other half of the estate, left to tho uho of tho Mormon church, Is not contested. |
