| Show ELKI > S USD SUIT The Charges Made Uy the PlaintifS Against the Senator NEW YORK Nov 20The hearing of a suit in which Wm C Reeves sues United Stakes Senator Stephen B El kins of West Virginia to recover an i interest Claimed by him in certain lands in New Mexico and also for an accounting ac-counting was commenced today before Judge Patterson in the special term of the supreme court It is claimed by the plaintiff that in 1S71 Mr Elkins purchased pur-chased some land in New Mexico in which the plaintiff was to have an Interest In-terest of one third and that a deed to that efteet was executed under which his interest in the land was to be held in trust by him for the defendant Mr El kins he alleges has sold a portion of the land and has received a considerable consider-able amount from its sale for which he has never accounted Senator Elkins acknowledged that he purchased the land and that on October 17 he signed a deed under which Reeves was to become entitled to onethird of the lands on paying him 125 an acre for them This was he avers the only pacers ever executed The plaintiff the defendant alleges agreed to pay this price for the land in a short time but never did so He finally told the defendant he was not in a position to carry out his agreement agree-ment and relinquished his interest in the lands Under these circumstances Senator Sena-tor Elkins says he sold the portion of the lands claimed by Reeves to T B Catron on the same condltons as they had been previously held by the plaintiff He also pleads that Reeves is barred by the statute of limitations |
