| Show ARBITRATOR KERNS VIEW Thiiilcs J AV Farrell Co Should Be Tai Salt Lake City Utah Nov 20 1895 To the Editor of The Herald The remarks made by the president of the city council at last nights session ses-sion in relation to the claim of J W Farrell and company regarding the award made by the arbitrators for the electric wiring < of the joint city and county building were ewturely uncalled for forJ J W Farrell and company appointed me a Their arbitrator the city and county appointed Mr J G Midgley we two leSt it in the hands > of the probate pro-bate judge to appoint the third man because we could not agree between us who the third party should be I made it my special duty to look into the claim of J W Farrell and company regarding the electric wiring of tftie joint ciby and county building and have done so rand my explanation regarding tlhe itemized statement whicih we have rendered I am willing t make alt any time to the president or t any member of the council I have only found a few members of the council who inquIre into the facts and if the president in his judgment of the composition of itflie arbitrators had first investigated the matt he would have been better informed and would not have waited this remairks before knowing anything about the facts in the case He had the opportunity oppor-tunity after voting once in favor of the report of the committee cmldlt e elgthit days ago to inquire into the particulars I respectfully ak the hanoralble president and he council to look into the itemized statement of the arbitrators arbitra-tors and to explain to the taxpayers if J W Farrell and company is not only entitled to the amount awarded but also to the interest on the amount unjustly wihWeld from the conbraidtiors by the architect and the joint city and county committee I only regret that the president of the council was not better informed before making such uncalled for assertions against the arbitrators and I believe that the mistake made by not paying T W Farrell and company the amount recommended by the board of affibSbra tots and the committee will prove to the president that the taxpayers 1he rsIdent nrt taxpaYeS of Salt Lake county hereafter must not only pay the amount > of 606642 but in addition will 0 compelled to pay the interest on that amount from the 15th day of December 1893 to date Respectfully M D KERN Arbitrator |
