Morning PROVO Nov OThls morning Judge Henderson delivered the closing argument for the defense in the Alma Hague case He made an earnest logical argument carefully going over each feature of the case showing that there was no evidence whatever to I show that Alma Hague had forged the Ingram Bros note or any of the notes Introduced in evidence and this case hinged entirely upon the question of Mr Hagues innocence or guilt of the forgery of the Ingram Bros note Judge Henderson talked for nearly two hours Judge Judd closed for the prosecution prosecu-tion and made a lengthy argument reviewing re-viewing the evidence and calling attention tent n to the entries on the books and the confessions of defendant which he I claimed wove a net of guilt around defendant de-fendant so strong that no evidence of previous good character and no villifl cation of the prosecution cr eloquence by the counsel for the defense could overcome At the conclusion of Judge Judds remarks re-marks the court instructed the jurors who retired about 4 oclock No verdict ver-dict is looked for tonight Suit Ajrninst KepUi Savings Hank I Chris Peterson has filed a suit against the Nephi Savings Bank Trust company for 2250 with interest at 5 per cent per annum compounded quarterly from April 1 1889 He alleges al-leges that he deposited the above amount in the bank at that time and that defendant has not paid the same nor any part thereof Plaintiff is a resident of Deseret Milliard county A Pay son nape Case Charles Edwin Booth was brought over from Payson this morning and placed in the county jail to await the action of the grand jury in default o acton 5800 bonds on a charge of rape City Marshal Ballard of Payson brought the prisoner over Mr Ballard says that Monday evening Booth who is a man about 20 years of age and a resident resi-dent of Salem was going to his home from Payson On the road near Pay son is the home of Mrs Rosina Frpi n woman about 35years of age where she lives with her four children Booth got off his horse and went to the house where he met Mrs Frei outside of the house and by threats and force accomplished accom-plished the offense which he is charged with The screams of Mrs Frei and the children brought neighbors to the house before Booth had left but he succeeded in mounting his horse and escaping Neither Mrs Frei nor the neighbors knew him but Marshal Ballard Bal-lard went to Salem yesterday and from descriptions given him succeeded in finding the right person who was taken ta-ken before Justice Barnett of Payson where he pleaded guilty and was bound over to await the action of the grand jury in 800 bail Last evening a number of boys and men gathered around the Pa yon jail having first ent a boy to tell Booth that about 500 men were coming to lynch 1 him The prisoner was very badly frightened and his appeal for mercy and aid aroused the neighborhood neighbor-hood for blocks around and caused Marshal Ballard to proceed to the jail to investigate the cause of the noise The crowd dispersed as soon as agked to do so by the marshal apd he does not believe that the men had any other intention than to frighten the prisoner Booth claims that he does not remember re-member committing the crime and explains ex-plains that he was drinking at the time Mrs FrI is sufferin severely from the effects of the violence inflicted on her by young Booth Pelican Point Investigation Last Saturday the grand jury began I the examination of witnesses in the I Pelican Point murder case which attracted at-tracted so much attention last spring when the bodies of three young men were found near Hays ranch on tho w ° st side of Utah lake The evidence at the coroners inquest disclosed thai the men had been murdered and thrown into the lake presumably sometime some-time in February last but so far the perpetrator or perpetrators of the triple crime have not been brought to justice The officers however have been quietly working on the case and all the evidence they can produce wiH be submitted to the grand jury There are many witnesses to be examined and it is not probable the case will be concluded this week week The officers are reticent in regard to the result of their efforts to discover the guilty party and nothing will be known in regard to the matter till the grand jury has finished its consideration of the case Peddling Stolen Goo tIs W TV Baker and Jas Stanley two tramps were brought over from Springville this morning and lodged in the county jail to serve a fifty days sentence imposed by the Springville justice of the peace for stealing clothing cloth-ing and dry goods from a Springville store The goods were taken to Spanish Span-ish Fork by the thieves there they attempted to dispose of them and were arrested for peddling without a license The officers then began to make inquiries in neighboring settlements settle-ments as to whether any goods hail been stolen with the result that it was learned that the goods were taken from a Springville store The tramps were taken to Springvills and found guilty and sentenced as above stated |
