CAPES BOUND OVER The preliminary hearing of W D I Capes who was arrested for assault upon Harry E Rogers last week with Intent to commit murder was held before be-fore Judge Bagley yesterday afternoon The evidence in the case conformed to the story as told in The Herald at the time The boy Fred Huff who it was claimed by Rogers witnessed the affray gave his testimony and L corroborated cor-roborated Rogers statements tin the main saying that Capes came into the shoe shop and requested him Huff to retire and when part way across the stredfc he heard a noise and turning saw through the glass door Rogers struggling with Capes and heard a shot fired After hearing the evidence the court bound Capes over in the sum of 300 to aiwalt the action of the grand lury
