Show WILL ISSUE CERTIFICATES Court Gives Authority to Receiver of the Pennsylvania Smelting Co F H Officer the receiver of the Pennsylvania Smelter company was yesterday authorized by Judge Cherry to make contracts for a period not exceeding ex-ceeding 12 months for ores fluxing material ma-terial and supplies needed to run the smelter and also to make repairs to the machinery at a cost not exceeding 3000 The receiver was also authorized author-ized to borrow 50000 for the purpose of running the business and to issue receivers certificates for the same which will be a first lien on the property prop-erty Firemens Cases Dismissed On motion of Attorney Joseph Lipp man the cases of Firemen Mowers Gilbert McMullen and Clark against Salt Lake City were dismissed The plaintiffs sued to recover S4000 for wages during the time they were unlawfully un-lawfully suspended from service in the fire department and a compromise having hav-ing been effected some days ago the cases were dismissed The Brick Kiln Case The hearing of the case of the Utah Portland Cement company against the Centerville Brick Kiln company was resumed yesterday before Judge Cherry and the Jury and was still proceeding when court adjourned until this morning I morn-ing The plaintiff sued to recover 15000 damages alleged to have been sustained by the defendants furnishing a defective kiln which did not work so I as to make good brick i Alleged Horse Thieves Henry Davis and J W Burdell were arrested on a complaint sworn to by Eeputy Sheriff A J Burt charging him with grand larceny for stealing from Arthur Seeley two horses worth 50 each a set of harness worth 20 a buggy worth 60 and a whip lap robes etc worth 425 They were arraigned before Justice Margetts pleaded not guilty and were held in bonds of SOO each pending the preliminary hearing on Tuesday next Failing to obtain sureties on the bond they were placed in the county Jail Court Notes The American Type Founders company com-pany has entered suit In the Third district dis-trict court against McLeod Paulson and Scipio A Kenner to recover 74620 alleged to be due on promissory notes secured by a chattel mortgage on a I printing plant Judge Cherry will make a setting of cases tomorrow for trial from April 15 to April 30 both inclusive A jury list for service at the April term will also be drawn on Saturday afternoon The Burnincham case now on trial before Judge Norrell is the last criminal crimi-nal case on the calendar for the term I of court and the jurors in attendance I In the criminal division of the district court were all excused for the term except ex-cept those engaged in the Burningham i case 11 |
