Show TH BANK CASE Very Important Decisions Made by Judge Bunne at St Paul I St Paul April SAfter litigation unprecedented in this state Judge Bunne of the district court has filed decisions in the Bank case Following Follow-ing the suspension of the Bank of Minnesota Min-nesota the Germania and Allemania banks many depositors applied for an order that their money and checks be returned to them In the case of the Bank of Minnesota Judge Bunne examined the question o the Insolvency of the bank previous to Dec 22 when it failed He finds that the bank had persistently violated > vio-lated the state banking law that the officers had been receiving deposits I with the full knowledge of the banks insolvency and that the guilty knowledge knowl-edge give to its depositors the right I to get their money if they can trace it to receivers With respect to each of the classes of funds the court makes a distinct order in the case of each bank The court holds that the title to the checks on other banks remains with the depositors but the cash deposits cannot can-not be traced and therefore cannot be recovered |
