reports and the horticultural blI I also found time to kill Roylances bill amending amend-ing the statute of limitations which when 17 members were absent came within one vote of a constitutional majority ma-jority Commencing tomorrow the house will meet at 9 l am The committees have been instructed to report all measures by Tues di and by long sittings and close application ap-plication to business It is believed the work of the session can be disposed of Consideration of the public lands bill was postponed until Monday TO LIMIT SPEECHES Shepard offered a resolution limiting speeches to two minutes and designating Gibbon as timekeeper with Instructions to call time on members exceeding the limit The house he declared must set down to business without further waste of time Thoreson thought such a measure came with bad taste from a member who had II wasted twothirds of the time of the session ses-sion His motion to lay on the fable was I defeated and the resolution v a then was effected by an agree I ment to retain the first four lines and the last three lines of section 5 The senate amendments to house bill 93 b > OBrien permitting cities towns etc to fund floating indebtedness were concurred con-curred in and the bill passed AVhen the senate amendments to house bill No G providing for distribution of the territorial supreme court reports came before the house Shepard move that the house do not concur The senate amendments reduced the number of sets of reports for Salt Lake county from three to one I Kenner pokeIn a sarcastic way about the superior wisdom of the upper house He was not one of those who were struck dumb by contemplation of the Intellectual Intellect-ual power of the senate but in this case he did not believe that body could be induced 1 in-duced to change its views I Shepard was not in favor of swallowing everything that the senate did and after further discussion a conference committee tee was appointed consisting of Shepard Thoreson and OBrien The committee on horticulture recommended recom-mended the rejection of house bill No 4S by Kenner providing for the appointment of fruit tree inspectors as its provisions were covered by the code v The labor committee recommended the passage of a substitute for house bill No 1J by OBrien relating to the payment of wages to employees of corporations The ways and means committee recommended recom-mended the rejection of the claim of Millard county for uncollectable taxes as to grant such claim wouid be in violation of the constitution THE RAILWAY BILL The railroad committee recommended the rejection of house bill No 12S by Forshee fixing maximum freight and passenger rates The committee on private corporations recommended the rejection of house bill No 110 by Wilson requiring insurance companies to make deposits for the protection pro-tection of policy holders the subject be Iri covered by the code he judiciary committee presented the following reports Recommending the rejection re-jection of house bill No 123 by Forshee relating to the disposal of estrays recommending recom-mending the rejection of house joint reso luton No 21 by Taylor proposing to amend the constitution to permit the exemption ex-emption of mortgages trsm taxation recommending the passage of house bill No C by Wilson relating to the sale of personal property under liens recommending recom-mending the rejection of house bill No 116 by Kenner for the protection of hotel ho-tel and lodging house keepers as the subject was fully covered by another bill that had been favorably reported Kenner declared that the two bills did h i rot cover the same subjects The Wilson Wil-son bill related to lens and his measure provided for the sale of pledges by hotel keepers when such property was not covered by lien He moved that the report re-port of the committee be rejected Sloan moved that further consideration be postponed Snepard took the floor to oppose the motion and was interrupted by Sloan Mr Speaker I have the lloor protested pro-tested Shepard Mr Speaker I rise to a point of order or-der exclaimed Sloan Both gentlemen will take their seats commanded the speaker sharply Sloan raised the point of order that the motion to postpone was not debatable The pint was overruled Sloan appealed and the chair was sustained The motion to postpone consideration was carried Taylors joint resolution proposing a t constitutional amendment was ordered printed The live stock committee recommended the rejection of house bill No 57 by Ray relating to the bffoullng of waters A minority report signed by Ray Dotson ind Martin recommended In the interest inter-est of suffering humanity that the bill I be passed The minority report was adopted and the bill ordered printed Fur hees classification and maximum I rate bill was also ordered printed notwithstanding not-withstanding the unfavorable report of I the committee During the discussion Romrey and Kimball of aU members be limited I to one minute I move to amend by making I one second said Sloan The motion was ruled out of order HORTICULTURE BILL House bill No U by IJennion creating a state board of horticulture was taken tip on third reading The bill is a very long one and the opponents of the measure proposed to kill I without discussion dis-cussion or waste of time After the reading read-ing had proceeded for 15 minutes Romney moved to strike out thp enacting clause Bennion protested against such a method of dealing with so important a measure and the motion was defeated The author au-thor of the bill remarked that the members mem-bers who were disposed to kill I without I with-out investigation knew nothing about a l horticulture I i After several unsuccessful efforts to bring the house to a vote on the bill without 1 with-out debate the reading was finished and t Bennion took the floor to explain its provisions pro-visions He claimed the present law was very defective and under its provisions Cr the state inspector simply drew his salary of 1500 per year for doing nothing The 01 < pending bill provided more economical C and more effective methods Under pre eat conditions fruit was coming In from other states by the carloads and money was going out of the state almost by the carload Romney In a spirit of levltv offered as n amendment a provision that the officers offi-cers to be appointed under the bill be given all the fruit raised in the state in part payment of their salaries The bill was discussed for an hour and a half and then made the special order for Tuesday at 23f Those who favored the bill represented that in Utah the conditions con-ditions were most favorable to fruit grow c ins nd Instead of Jmportjng fruit for home consumption the State shbuld l > e a heavy exporter The members who opposed I posed It believed it iiVolved a heavy expense I pse pease to the state and that each county I should make Its own regulations During the discussion I was developed that the bill was supported by the Salt Lake County Horticultural society STATUTE OF LIMITATION The judiciary committees substitute for house bill No S by Roylance was next on the calendar Roylances bill amended the statute of limitations bj extending the time for commencing actions on judgments notes and accounts and by providing that a payment on notes or accounts would extend the time for the commencement of actions to date from such payment The substitute extended ex-tended the time on open accounts only The house voted to substitute the original or-iginal bill for the judiciary committees pill Roylance knew that a majority of the members favored his measure and was somewhat astonished when the roil call showed but 2 aHlrmatlve votes one less than a constitutional majority I was then nearly C oclock and there were ii absentees Roylance vainly endeavored to get a notice of reconsideration before the house but he had voted on tile wrong side and the bill was declared rejected decared I is understood that a similar measure simIar will be introduced In the senate Kenners income tax bill was made the bI special order for Wednesday at 3 oclock An Invitation from Moses Thatcher to the members and officers of the legisla ture to attend a reception at his residence Tuesday afternoon was read and Rom ney moved that i be received with thanks and spread upon the minutes Mrs Anderson An-derson offered an amendment that it be accepted and the amendment was accepted ac-cepted and the motion carried The house then adjourned to meet tomorrow to-morrow at 9 oclock Legislative Notes Tho regular sessions of the house will hereafter commence 0 at 9 oclock Shepard admitted that he was not a horticulturist like OBrien and Sloan I dont pretend
