The suit, filed in Coalville's 3rd District Court Nov. 19, claims the Jeremy Foundation run by Dr. Gerald H Bagley did not meeiihe V terms of a written agreement in connection con-nection with the 1985 Shootout at Jeremy Ranch. The tournament is sanctioned by the Pro Golfer's Association (PGA). The suit asks for repayment and damages in excess of $1 million and seeks another $500,000 in punitive damages. The suit also names Bagley individually, in-dividually, as well as Richard Sorensen, Production Catering and Scott Wilkey. The suit claims that Bagley's foundation foun-dation agreed to pay Jeremy Service Corp. $500,250 of the first $667,000 made from the tournament. The suit alleges the defendants intentionally disregarded the terms of the agreement agree-ment and caused the funds, over which the foundation had control, to ' be "diverted" to Bagley or the foun- v dation in violation of the contract. In addition, the suit claims that Bagley failed to pay to the service corporation a $100,000 golf course rental fee for the tournament. In an interview, Blair said that Jeremy Service Corp. had to guarantee $450,000 in prize money to the PGA before the tournament could be played at the Jeremy Ranch golf course. The Jeremy Service Corp. contends con-tends in the legal action that the breaches of contract have cost the corporation a minimum of $250,000. The suit argues that the defendants kept money earned from "the 1985 Shootout with the intent to . . . defraud the plaintiffs (Jeremy Service Ser-vice Corp.)." The suit states that Bagley submitted sub-mitted a financial accounting of the 1984 Shootout to the service corpora-? corpora-? tion. that showed it had generated ,h$944,857.
