Tho matter involved was directly di-rectly related to the main issue in other cases of similar title, which maintain a group of San Francisco business houses have sought a ruling enabling them to consolidate express shipments in New York and bill 10 a common consigee in San Francisco. In today's hearing, the complainant fought to collect a refund of payments pay-ments made last fall, when the express ex-press company agent In New York refused an aggregate bulk rate upon a number of packages intended lor the same consignee upon the same lay. It was shown that the packages which were consigned to the California Califor-nia Commercial association, bore individual in-dividual numbers which corresponded to the names of firms having membership, mem-bership, but that tho express company had enforced the individual package rate until they had been furnished with a certificate showing that these numbers designated one consignee, and one only. As lo certain matters of fact involved, it was agreed that depositions should be taken In New York, and the matter was submitted. Commissioner Lane ordering that the last brief should be submitted within a period of sixty days. The main case against the express company, wherein the California Commercial Com-mercial company Is to support Its claim to the right to consolidate shipments ship-ments in New York, will come up for supplemental hearing tomorrow and will probably occupy the entire day. The complaints of th Jobbers' association asso-ciation against the Southern Pacific company, based upon the protest against sw itching charges, will be-the bads of Wednesday's hearings. In another of the related cases, wherein a partial hearing has been had before the commission. Commissioner Com-missioner Lane promised to prefer a lequest for further argument before the entire commission at Washington. It was agreed, however, that no action ac-tion would be taken until the decision upon the reasonableness of the rates Its banded down. |
