Show JITNEY BUS CAN NOW OPERATE ON THE CITY'S STREETS This morning the city board of commissioners com-missioners passed an ordinance repealing re-pealing an ordinance providing for the licensing of hacks, busses, automo biles and other vehicles for hire, which clarifies the situation respect ing tho application of the Jitney Service Ser-vice company for licenses to operate five passenger automobiles in the city. The new ordinance repeals that part of the old ordinance which provided for the licensing of passenger passen-ger automobiles for hire, and, under Its provisions such autos may be operated op-erated in the city free of charge. The new ordinance is published in full In the Standard this afternoon Immediately after tho passage of the repeal ordinance, the committee of the whole reported that, inasmuch as there was no provision for the licensing li-censing of passenger automobiles for hire, the Jitney Sorvica companv should have the amount it advanced for five licenses refunded. The treasurer treas-urer was directed to refund the $12:". w-hich was advanced when the application appli-cation for the licenses were made It will be recalled that a number of weeks ago the Jitney Service company applied to thfi board of commission ers for five licenses and the application applica-tion was referred to the committee of the whole. Since that time the company applied to the district court for a writ of mandate to compel the city to grant the licenses. On demurrer de-murrer on the part of the city, the petition was virtually set aside by Judge Harris and Mie company filed a new application for the licenses, also al-so demanding their Issuance, threatening threat-ening further proceedings toward securing se-curing a writ of mandamus if the licenses li-censes did Issue. Since then the committee of the whole has had the matter under advisement, culminat ing In the report of the committee of today "The repeal of the old ordinance." said City Attorney Valentine Gideon today, "clears the situation and leaves the board oT commissioners in a position po-sition to regulate by ordinance the automobile passpnger traffic for hire In the city, which will directly settle the question of the manner in which the jitney bus shall be run By the repeal of the ordinance, the jitney company may ro ahead with its service ser-vice without charge, and without approval ap-proval or disapproval by the com mis sioners I suppose the company will begin running its cars over the streets of the city, which it has a perfect right to do. It will not be long, how ever, until an ordinance regulating the traffic will be taken up by the board " |
