Show INFECTED PEARS PLACED ON SHELVES FOR SALE V. Lobello was tried this morning in the municipal court on the charge of having pears Infected with the San Jose scale and apples infected with the larvae of the coddling moth, on sale at hlB place of business, 2002 Washington avenue. The case was the first of the kind prosecuted In the city for nearly two years and the complaining witness was R. N. Ras-mussen, Ras-mussen, county horticulturist The defendant was represented by Attorney Attor-ney D. L. Stine and tho prosecution was conducted by County Attorney Joseph E. Evans. Mr. Rasmussen testified of finding infected fruit In boxes placed on tho "show" shelves In front of Lobello's store, presumably for sale. Samples were placed in evidence. The witness wit-ness also stated that he had warned the defendant several times against buying or selling Infected fruit. The testimony of tho defense was to tho effect that the fruit had been given to Mr. Lobello for chicken feed and that it had boon placed on the "show" shelves by his young daughter, daugh-ter, by mistake. , nn |
