A statute of New Hampshire, prohibiting pro-hibiting a bequest to a church or more than 55,000 annually, and one of Massachusetts forbidding more than 52,000 annually, are the basis of the opinion, which was written by Professor Profes-sor Taylor, formerly minister to Spain. "As to the void gift, the testatrix died intestate, and its subject matter passed on her death to her next of kin, under the New Hampshire statutes stat-utes of distribution."' In the closing paragraph, the opinion opin-ion advises the nt,tornc3's for the next of kin that such agreements and contracts con-tracts as they made with the testatrix testa-trix and her trustees in hor Hfetlmo bind them only "to recognize as valid such provisions of her last will a3 aro legally valid." "To that extent," continues tho opinion, "you are hound and required to join with the oxecutors In requesting request-ing tho probate court of New Hampshire Hamp-shire to admit such will to probato in solemn form, in order that all its provisions pro-visions may prevail so far as thoy are not forbidden by law Courts to Construe the Will. After you have so acted and performed per-formed every part of tho ngrcement you nave entered into, it will remain for the courts of equity, federal or BUtc, to construo tho will In order to determine whether tho resIJunry clause is valid or void."
