Show POSSESSION OF SHOP IS INVOLVED The case of J. J. Smyth against the George A. Lowe company was called In the district court this mornlug. Mr. Smyth has commenced the suit against the defendant company to recover re-cover $1,580.99, alleged to bo due by virtue of tho forcible entry Into his shop, nnd the unlawful detention of certain tools and goods. It is said by the plaintiff that the defendant company, com-pany, about March 10, 1909, took possession pos-session of his shop and has since retained re-tained certajn goods and tools belonging be-longing to him, the valuo of which ii state as $1,586.99 , In tho answer mado by the defendant defend-ant company, It Is claimed that the property In question was taken possession pos-session of by virtue of and upon the authority granted In a certain chattel mortgage to secure the payment of $580.47, due on a promissory note. It is cxpocted that tho, hearing or the case will consume nil of today and, perhaps, tomorrow. |
