A minimum sentence of five years imprisonment in tho federal penitentiary w"as Imposed Im-posed by United Slates District Judge Roberts Beau today upon William F Kettenbach and Geo. H. Kestler, for mer president and cashier of the Lewlston National bank of Lewlston, Iaaho, who were last night found guilty by a jury on tho charge of lalsltying reports to the comptroller of currency. cur-rency. On indictments charging abstraction ab-straction of funds of the bank, they were found not guilty . In passing sentence, Justice Bean said he considered the punishment proided by law too severe, but that he had no choice in the matter. Ho oerruled a motion for a new trial but granted a stay of execution of sentence pending appeal and fixed bonds at $25,000 each, allowing the convicted men ten days In which to provide a bond. It is understood, in case the judgment judg-ment of the lower court is sustained, an Immediate effort to procure pardons par-dons will bo made the statement of Judge Bean In passing sentence to be used as a basis for such action. Kettenbach and Kestcr have twice belore been tried In the federal court in Idaho on criminal charges. They wc-re convicted at Lewlston four years ago of conspiracy to defraud the government gov-ernment out of timber lands, but they secured a reversal in the United Slates district court of appeals. On their second trial In tills city, ono year ago, they wero acquitted. The case of Frank W, Kettenbach, uncle of W. F. Kettenbach, charged with the abstraction of $137,000 of the bunk's funds.
