In a rare move, the Georgia Pardons and Parole Board agreed last spring to act on a request for a pardon of Frank, convicted in 1913 of the murder of Mary Phagan at a pencil factory in Atlanta. The request came from the League of B'nai B'rith, the American Jewish Committee and the Atlanta Jewish Federation. board will deThe cide on that pardon as early as Dec. 15 or certainly before the end of the month. The pardon request rests on affadavits and video taped interviews given to Nashville's morning newspaper, The Tennessean, last year by Alonzo Mann. Mann was an office boy at the time the girl's body was found in the basement of the National Pencil Co. Mann has stated that Frank did not kill Mary Phagan. He said the killer was Jim Conley, the prosecution's main witness. The Tennessean, in an extensive look at the case, was told by Mann that he saw Conley, the black janitor, carrying the body of the little girl on the first floor of the factory. That statement, along with others, contradicted Conley's testimony during the trial. - ATLANTA five-memb- er It's extraordinary." The 1913 Memorial Day killing of the little girl, Frank's conviction during a trial marked by vehement sentiment, the legal appeals, Frank's lynching, and the political careers of several were part of Georgia history spread across the newspapers of the nation. The murder nearly 70 years ago led to a resurgence of the Ku Klux Klan across the South, and the lynching helped inspire the formaAnti-Defamati- an organization devoted to countering It was a time during which the souls of many were tested. Frank's prosecutor later became governor, while a politically active weekly newspaper editor, Tom Watson, who railed against the "Jew Sodomite," was elected U.S. senator. The presiding judge in the case, in during the trial, later died in a mental hospital in South Carolina. The governor who commuted Frank's sentence to life in prison less than a week before leaving office tad to call out the National Guard te protect him from an g mob. Over the next two years his appeals went as far as the U.S. Supreme Court, but that court and all others turned him down. Finally, on June 21, 1915, Gov. John Slaton commuted his hanging sentence to life in prison. But on the morning of Aug. 17, 1915, Frank was roused from his bed at the Milledgeville state prison farm and driven to Marietta 25 miles north of Atlanta by a group of men calling themselves the Knights of Mary Phagan. There, from an oak tree in sight of where Mary Phagan was born, he was blindfolded and hanged.
