Show Hanksville news notes ... By Barbara Ekker A Wayne County educator educa-tor who lost his job due to an alleged reduction in force (RIF) situation resulting re-sulting from a decline in enrollment, is taking his case to the Utah Supreme Court. Mr. McClean Dur-fey, Dur-fey, a former counselor at Wayne High School in Bicknell, had eight years of experience in the district when his contract for 76-77 was not renegotiated. renego-tiated. A district court decision denied him reinstatement. rein-statement. The UEA, NEA and the Wayne County Education Association Associ-ation are supporting Dur-fey.in Dur-fey.in the lawsuit. UEA Attorney, Michael McCoy termed the case, "an important one." His petition peti-tion in the case stated that Wayne County School did not comply with the Utah Orderly School Termination Termina-tion Act. That Act gives educators the right to a notice and hearing in case of termination proceedings, proceed-ings, the right known as "due process." "The practice of the RIFing without due process pro-cess deprives a teacher of the opportunities to hear the case against him and to present his side of the story," McCoy said. The attorney said he would appeal on further grounds that there was no decrease in student enrollment, a position was available, the district violated it's own policies and that the court allowed certain evidence in error.
