Show City Court Actions Moab City Court listed a busy week of activity with three separate instances of destruction of property coming com-ing to the attenion of Judg? Donald Crist. On July 13, Robert Lemon appeared for trial on a charge of malicious injury to or destruction de-struction of private property in an incident which occurred occur-red at Gordon's 7-11 Market. Ho had earlier entered a plea of innocent to the charge and after hearing evidence, the court found him not guilty, but ordered him to mak2 restitution for the window which was broken in the incident. in-cident. Judge Crist stated that the Court found that although al-though the window was not broken with malicious intent, it was broken by Mr. Lemon as he fought with another man. Appearing on behalf of his client was Attorney William Benge on July 13. Geo Hy. ita had been charged with fraudulently obtaining public assistance and had entered a plea of innocent to the charge. char-ge. His attorney advised the Court that Mr. Hyita wished to change the plea to guilty and Judge Crist sentenced him to a stay in jail of 60 days with the sentence suspended sus-pended and Mr. Hyita placed on probation for one year. During the probationary period per-iod if Mr. Hyita commits a crime similar to this one he will be required to serve the sentence. He was also required re-quired to make restitution' for the $224 which had beea fraudulently obtained. Also appearing on July 13, was- Danny Wright on a charge of injury to or destruction des-truction of property. This stemmed from an incident on July 12, in which he cut a hole in the roof of a Volkswagen Volks-wagen belonging to his ex. wife. The court, after he entered en-tered a plea of guilty, ordered him to spend 60 days in jail with the sentence suspended upon the condition that he. make restitution and if he is found guilty of any further molestation of his ex-wife, he will be required to serve the jail term. . .- ...... ,On Iune 14, Doug Hansen! appeared on a- destruction- of private property charge arising aris-ing from an incident at Moab City Park during May. He appeared without counsel and was found guilty and sentenced-to 10 days in jail with the sentence suspended. Possession of a controlled substance was the charge which brought written plea from Ronald Clark on July 14. Clark entered a plea of guilty by letter and was fined fin-ed $300. His bail was forfeited for-feited in lieu of the fine. A guilty plea to a charge of DWI on July 17, brought a fine of $200 or 40 days in jail, to Steven B. MercilTe ofJ Walden, Colo. Bert Powell appeared and1 entered a plea of innocent to a charge of possession of a controlled substance on July 17. His trial was set for August Au-gust 11. Two girls, Rosemary Housekeeper House-keeper of Orem and Venita" McKinney of Grand Junction alsp appeared on July 17 on charges of public intoxication. intoxicat-ion. Upon motion of the County Attorney, the charges were dismissed against Debra Deb-ra Tulley and a guilty plea was entered by Mr. Halliday on behalf of the other two defendants.
