Show ASKS DISMISSAL OF CASE AGAINST HOLM A plea of not guilty to the charge of petty larceny was entered by Charles F. Holm before Judge Diehl this morning. At the same time counsel for Holm moved that the case be dismissed on the ground that the liberty of Holm had once before been in Jeopardy in connection with the same offense. Holm was arrested several weeks ago charged with having stolen a quantity of meat from a Commercial street restaurant. restaur-ant. He was bound over to the District court. Before the case was called for trial in the District court it waa discovered that the evidence was not sufficient to convict and the case was dismissed. Holm was immediately arrested on the lesser charge. Counsel for Holm asked for an order on the clerk of the District court to produce the files in the first case. The case will be heard by Judge Diehl April 25. |
