Magurl told the policemen po-licemen that there was nothing wrong in his house. The action of Magurl, however, aroused the suspicion of the police and they demanded admittance. As soon as they had entered the house Magurl began be-gan to talk. . He said he had returned home from a run several hours before he was expected. . He had doubled back from Provo instead of going to the end of his run. As he passed along the side of his home he noticed a light in the bathroom, also one in the room of his wife and one in the room, occupied by J. A. Peebles, an O. S.' L. engineer, who has been rooming at the Magurl home. , . : The returning husband did not take kindly to the appearance of his home surroundings and promptly kicked in one of - the doors and hurried to the room usually occupied by Peebles. The latter was not there, but a revolver lay on the dresser in the room. Gabbing Gab-bing the revolver Magurl was about to enter the room of his wife when he was met by Peebles. The enraged husband at first planned to kill Peebles, but on second thought he laid the revolver down and told Peebles to get out of the house as he was too small for him to kill. As the two men were talking the wife entered the room and the husband promptly told her what he thought of her' and her actions during his absence. So enraged did he become that he made an attempt .to strike his wife. Peebles is said to have secured the revolver in the meantime, and as Magurl attempted the assault on his wife Peebles struck him over the head with the butt end of the revolver. The two men started a struggle for the revolver, during which two shots were fired. Peebles secured possession of the revolver and escaped from the house. The police at once started an investigation. They discovered Mrs. Magurl in the basement clad in a kimona. Peebles was found in the house next door. He was lying on a couch with a quilt over him. It was necessary for the police to go to his room at the Magurl residence and secure se-cure a few articles of clothing before he could be taken to the station. |
