Show Bodera Plans S 5 00 Bond To Quditfy tfor Office' Legal opinions Tuesdsy still entangled en-tangled the caae of whether there exists a vacancy In the Salt Lake county commission as a result of the death of B. A. Rasmussen (R) Dec. 10, after having been elected for the two-year term, defeating Commissioner Roscoe Boden (D), but Mr. Boden said he planned to post a $5000 bond Friday to "qualify "qual-ify for office." Mr. Boden, in charge of public health and charity, aald h as aaked for a bond -and will submit it for approval to a Third diatrict court judg before it la recorded and filed with the county clerk. There still remains some differences differ-ences of legal opinion. One section sec-tion of the law ssys that an elected county commlasioner can hold office of-fice until a successor Is elected and qualified. Another section says that th remaining county commissioners com-missioners shall fill the vacancies within 30 daya after th vacancy j occurs, and if this Is not done, the governor shall make the appointment appoint-ment within the following 30 daya. It also points out that vacancies in all cases must be filled from the aame political party to which the person belonged, whoa eligibility, eligi-bility, death or refusal to act, or other disability, occasioned the vacancy. Mr. Rasmussen died before he was duly qualified to take office . . . posting of a bond and taking th oath. |
