Show "STATE TO AMEND ROAD RULINGS At the suggestion of the Federal Public Roads administration, the state road commission is planning plan-ning to include a county maintenance mainten-ance clause in its agreements with counties over the expenditures of Class B road funds. Atty. Gen. Grover A. Giles, in an opinion to Roy W. McLeese, commission's com-mission's chief engineer, said such a clause could be inserted provided provid-ed it was "mutually adopted by county commissioners and the state road commission." Mr. McLeese said counties are not required by law or agreement to maintain county roads on which Class B road funds are spent. He said in the future, however, it was intended to allocate federal secondary funds for use on class B roads and the commission in tends to ask counties to assume the responsibility of maintaining them. The attorney general cautioned the commission to avoid "misunderstandings" "misun-derstandings" with counties if the maintenance clause is inserted in Class B road fund agreements. "Should it be determined to include in-clude such a provision, care should be taken to properly define who is to determine whether or not the maintenance is satisfactory," he wrote. ' |
