Show DEFENSE LOSES GROUND, Demurrer of J. S. Lewis Against Plngrcc Bank Is Partially Upheld: Special lo Tho Tribune. OCDDN, Dec. S. Two Important points sot up by the defense In tho case of J. S. Lewis & Co. against the Plngreo National bank were eliminated today, when Judge F. C. Loofbourow of Salt Lake sustained tho plaintiff's demurrer lo certain sections sec-tions of tho defendant's answer. Mr. Lewis instituted an action for damages against tho bank for the construction of the now bank building out over the property prop-erty line onto the sldowalk, and also ovor onto the plaintiff's building, according accord-ing to the original complaint. Tho plaintiff entered a demurrer to the allegation of the defendant's answer that It has been customary In Ogden to usurp tho city property with buildings, sidewalk side-walk show cases, basement stairways and other private structures. It was also asserted as-serted by tho defendant that bluo mints of the bank building with portions of the structure extending out over the proporty line had been approved by the city building lnspoctor and city commissioners commis-sioners bofore work was started. Both of these allegations were ordered' stricken from tho defendant's answer, on the grounds that they were Irrelevant. |
