In Judgo Lewis's division of tho district dis-trict court Wednesday morning, upon motion of District Attorney Fred C. Loofbourow. Miss llnyden was discharged dis-charged and is now 011 the way to her homo in San Francisco. Insufficiency of evidence was tho reason for the district attorney 's motion mo-tion to discharge Miss Hayden. When Davis's case was called for trial Davis went upon tho stand and confessed to tho theft of the goods in question and exonerated Miss Hayden by declaring that, although she accompanied him lo tho store, she knew nothing of the thefts. Tho stato did not possess any evidence to show that the woman wns an accomplice in f lie theft and for this reason moved tho dischargo of Miss llavden. Miss Hayden ' father. IT. E. Hayden. is the manager of a theater at San Francisco, and tho woman will probably return to the stage 1 hero. Beforo she left she received money from her father, fath-er, with -which to fight'lhc case against her, which sho turned over to Davis. There were nine other arraignments before.
