The Smoot machine having degraded the judiciary of this Stnto so far as it found it possiblo to do, has now turned its attention lo tho degradation also of tho Federal court. Tho machino has confidently counted upon a portion of the Supremo Court of the Stato, nnd ha3 uudcrtaken to down ono upright, fearlesH, independent Judge because he would not bo subsorviont to tho bohest of tho machino. If ono woro to undcr-tako undcr-tako to count and namo tho district Judgos in this Stnto and sco how fow thorc aro who aro not under the control df the Smoot machine, ho would be both amazed and disgusted at tho lino-up. A woek ago today, Air. Kearua proposed pro-posed un eminent gcntlomon of Utah, learned in tho law and at proscut occupying occu-pying tho Federal District Bench of tho Stato, as a fit man to be considered in connection with tho appointmont to tho United States Supremo Court, to fill a vacancy about to occur. This is seized upon by a Smoot mouthpioca as an attempt at-tempt to sway, influence, corrupt, or triflo with tho judicial'. For somo time tho Smoot machine has boon anxious to divert attention from tho scandalous showing mado aud confessed con-fessed in tho attempt by Attorney-General Brecdcm and United States Marshal Mar-shal Spry to influonco Judge Howell of Ogdon for political reasons in the consideration con-sideration of a motion then ponding beforo him. Tho exposure of -that attempt at-tempt to influonco tho Judge was very ill received by the people of this State. Although everybody understands in a general way that the District Judges arc under the power of tho machino for tho most part, it yet camo with a shock of disagreeable surprise to find an actual instauce of it not only amply proved by tho statement of tho Judgo who was approached, but confessed as something so ordiuary as io be of no importance, by tho Attorney-General of the State, who was one of tho men who made tho nefarious attompt to influonco in-fluonco tho Judgo, politically, as to his ruling. Every effort to divert public attention atten-tion from that scandalous showing has been mado without success. And now, when an eminent citizen of this State urgc3 Judge Marshall in connection with an appointment to tho Supremo bench, that is back-capped with a farfetched, far-fetched, unreasonable and malicious attompt lo show that thero was an ulterior ul-terior motive behind it. That is to say, Utah men, no matter how eminent in thoir profession, no mattor how fit tho' 11133' bo for advancement, if that advancement is proposed in cortain quarters tho muck-rnko must be applied for somo base reason for the recommendation; recom-mendation; and if Utah men can bo kept back, if tho suggestion of thoir advancement cau bo undermined by an intimation that will prevent tho advancement being achieved, then tho malodorous tools of an autocratic hierarchy hie-rarchy consider that they havo done their ugly work to perfection. No sentiment sen-timent of loyalty toward citizens of Utah, no neighborly -affection for any 0110 who has rendered himself cminout in any lino of study or work, is to bo considered for ono moment if tho scandalous scan-dalous assailants can in somo way hatch up from tho filth' depths of thoir own depraved minds some suspicious imagining im-agining which they can urgo against him. Everything must .pass through tho church hopper or else it is to bo decried. There is a motto against the evil bird that fouls its own nost; and thero is a natural sentiment prevailing among decent de-cent men in ordinary American communities commu-nities that thoy will stand togother for tho common good in support of their own citizens who havo rendorod moritorious service, and whoso especially fit character char-acter signals them out as tho right men to bo promoted in tho public sorvico. But among the disgraceful rabble of tho Smoot machine no such sentiment prevails; tho hyena instinct to attack and destroy is "the dominant ono as to everything that is not proposed at church headquarters and handed out by tho predntory hand of, tho hierarch. Thoso that this greedy gang cannot use, they denounco; thoso men who have tho temerity to "propose any citizen citi-zen of Utah whom they themselves havo not first lauded (and they laud nono but their own filthy brood) is to bo.jlen,ouncod, his., motive 'impugned, and his purpose thwarted if possible. ( The scandalous attack mado upon Mr. Kearua by way of impugning his motives mo-tives and dragging tho namo of Judgo Marshall in tho dirt ia something to bo roprehonded by nil decent, men. Tho filthy machino which has its foul clutch upon tho throat of the judiciary of this State can think of nothing in connection with praieo for any Judgo not their own tool; and the man that utters that, praiso must, they chnrge, necessarily have an ulterior and dotestable motive as the inciting cause of his praise. It is a crime, it appears, to suggest or urge anything good for a Utah man, unless thoso who havo made Utah a malodorous stench in the nostrils nos-trils of tho Nation first propose it. The people are not in favor of the degradation of the bench; they pre not in f,avor of the dragging of the name of an honored Federal Judge in tho mire; they do not wish him placed in tho same category as that in which the Smoot Judges of Utah aro registered. They will resent this foul attempt to fasten an ulterior motive upon the proposition prop-osition for the advancement of a Utah man who is ominently worthy of all tho honors that can be hoaped upon him; and especially will they re6ont that proposition that a certain lot of autocrats auto-crats must havo ovory thing paes through their hands or thoy will bo-smirch bo-smirch it with their foulness, aud decry tho effort to advance Utah men by undertaking un-dertaking to throw mud at the motivas which promptod tho effort. The conspirators aro enjoying tho height of thoir power now; thoy may bo ablo to injure Utah for a time, and prevent tho promotion of Utah men who do not wear thoir braud, but the people will have their innings presently, and tho State will bo clcarod of all this band of vultures nnd hj'onas. |
