Show EVIDENCE IN VAN COTT CASE Prosecution Rests and Defense Moves the Court to Instruct Jury. A Jury was secured and the taking of testimony begun Wednesday morning before be-fore Judge Armstrong of tho Third District Dis-trict court In the case of Salt Lake City against Marlon Van Cott, principal of the Waterloo school, who Is charged with assault and battery for severely boating Duane S. Walker, ono of tho pupils in the school, with a strap. The first witness for the prosecution was. the boy himself, who testified that he had been punished three times within a short period of time because he would not obey his teacher. Mr. and Mrs. George D. Walker, father and mother of the boy, were called to the stand and testified as to the physical condition of the boy after he received his punishment, describing In detail the black and blue marks on the boy's back and across his arms and logs. Mrs. Woodmansee, Mrs. Norrell and Mr. McClelland, all neighbors of the Walkers, all testified that they had seen tho boy's body the day that ho was punished pun-ished by Mr. Van Cott and described the marks on the body as had the parents of the boy. When these witnesses had testified tho prosecution rested Its caso and then Attorney At-torney Ray Van Cott, for tho defense, made a motion that the court instruct the Jury to bring In a verdict of not guilt. The motion was not passed upon by tho court and the case will bo resumed at the opening of court this morning. |
