secure the foreclosure of certain mortgages on part of the lines I now operated in the valley by the Rio Grande Western Railway company was I filed in the United States court yesterday yes-terday The title of the suit is Nathaniel Na-thaniel W Raphael vs the Wasatch r Jordan Valley Railroad company the I Rio Grande Western Railway company I and the Union Trust company of New York as trustee The case dates back I to the early seventies The bill Inequity In-equity alleges that on May 1 1S79 I Jordan VnUe railroad the Wasatch Valley rairoad I conveyed to the trust company to secure se-cure mortgage bonds to the amount of l200OQOall that part of tho line then completed together with all appurtenances appurte-nances comprising thirtythree miles of main lie with eleven and onehalf miles of tramways running from Bingham Bing-ham canyon via Sandy to Alta The plaintiff claims the property was foreclosed fore-closed for default of payment of principal Ii prin-cipal and interest on the bonds and 4 came into the possession of the Rio I Grande Western through collusion and I fraud The plaintiff sets up his claim to the property through twoprior mortgages I mort-gages given in 1S73 and 1S74 and asks I the court to set aside the foreclosure sale to demand an accounting from the Rio Grande Western with payment for the use of the line the appointment I I of a receiver and a writ of injunction restraining the Rio Grande Western from using the line pending the determination I deter-mination of the litigation Pierce Crltchlow Barrette of Salt Lake and 1 Charles L Easton of New York are I attorneys for the plaintiff who is a resident of New York I The suit Is an interesting one as It Includes the BIngham branch which Is l most important one to the Rio Grande The line from Sandy to Wa I satch and Alta however Is worthless I and has been abandoned by the company com-pany for a long time as far as operation opera-tion of it as n railroad Is concerned i St John Has Resigned tax railroads I rail-roads In that State The roads involved in-volved were the Yazoo Mississippi I I Valley Railroad company and the Illinois Illi-nois Central In the general proceedings proceed-ings against the Yazoo City road the I court held In an Opinion by Justice Brown that the road was not exempt from taxation The decision in the I Illinois Central case was to the effect that the cases
