| Show 1 DULLIONBECK SUIT Twenty Thousand Claimed for James Mon alinns Death In the afternoon Judge Bartch took up the hearing of civil jury cases The first case taken up was the 20OGO I damage suit of John Monahan against i the BullionBeck Champion Mining company The plaintiff in this case alleges that on Sept 9 1890 James Monahan was in the employ of the defendant company at Eureka and in the discharge of his duties du-ties had to descend and ascend inn cage togo to-go to and return from his work On the dale mentioned while preparing to ascend as-cend from the mine M onahan was caught f between the cage and the wall and so badly mangled that he died almost in 4 Etantly Negligence is alleged on the part of the defendants in employing an incompetent cage tender and in the manner t I man-ner of the constrnction of the shaft through which the cage passed The defendants deny all of the material allegations of the complaint Judge Iioofbourow made the opening statement of the case In explaining to the jury how the deceased came to his I death Judge Loofbourow stated that llonahan was on the cage with several I other miners and the cage started upward while another workman was getting on snd that theIntter was in immediate danger dan-ger being killed The other miners while helping the last mentioned pushed Mon ahan against a projecting timber and he was killed The defense then moved for a nonsuit the ground that the prosecution hat failed to state a cause of action by admitting ad-mitting that Monahans coworkers wer responsible for the accident which caused his death The motion was overruled and the case was proceeded with until the hour of adjournment ad-journment It will be resumed this morning |
