Show CASA1 ISOlliI i Mrs Sharps Boarder Will Be Sentenced Monday ATTOES EYS HAYE A ROW Judge Powers and 2Lr Tarian Lose Their Tempers in Court Subsequent Apologies Ecstore Peace The + loungSclirocdcr Agreement Tails Aa Earls ITornHure Case The Bonds forfeited Brevities By 930 oclock yesterday morning every scat in the court room was occupied by those anxious to hear the arguments of counsel in the notorious Casady case By 10 oclock the room was packed and jammed and when court had been declare de-clare in session Judge Zane bad an officer stationed at the door and no one not interested in-terested in tho case except members of the bar were allowed to pass the portal Mr Baldwin made the opening argument argu-ment He stated that he had been friendly with Casadys family for some years past and was not in the case through a feeling of revenge but merely that justice might be done With reference to the suffering occasioned aIrs Casady by the acts of her husband Mr Baldwin thought that the only happy moment seen by her in two years would be when the doors of the penitentiary closed behind him Counsel then reviewed Casadys life for the past three years and made a good showing for the prosecution JUDGE POWEBSS PLEA He was followed by Judge Powers who made one of his characteristic speeches He began by stating that the case was one of much importance nnd he honed that the facts would be carefully considered consid-ered He them impressed it upon the jury that they were sworn to try the case upon the law and evidence produced pro-duced in open court and not upon the many suspicions circumstances that the prosecution had called attention to The judge then spent some time in roasting roast-ing Mr Baldwin humorously after which he settled down to business and I made a strong plea for his client United States Attorney Varian followed fol-lowed Judge Powers and closed the case for the prosecution Mr Varian made one of the best efforts of his life and his arraignment of Casady was of a scathing and searching nature Judge Zane then instructed the jurors and they retired to deliberate upon the case A DISGRACEFUL SCENE During Mr Varians argument a disgraceful dis-graceful scene occurred in which Judge Powers and Mr Varian took a part Judge Powers was seated by THE HERALDS reporter and on one or more occasions they had whispered to each other but with no intention of interrupting interrupt-ing the speaker Finally Mr Varian turned around and speaking to Judge Powers protested against being interrupted inter-rupted Judge Powers immediately arose and stated to the court that ho had not intentionally t inten-tionally interrupted ilr Varian but if he had done so he would make apology for it Mr Varian then accused Judge Powers of boorishness and lack of gentlemanly instinct and stated that no dramatic effort could be rung into the trial Judge Powers again addressed the court stating that he had apologized once for the alleged interruption and again protested pro-tested against Mr Varians insinuations The court called for order and Mr Varian Va-rian then made some further remark about a gentleman being interrupted when he was addressing a jury At this juncture Judge Powers declared If that there was no gentleman addressing the jury aiju yrian then applied a very vile epithet to Judge Powers in an undertone and the court again demanded order which was then restored GUILTY ON ONE COUNT The jury returned into court a few minutes min-utes before 6 oclock finding Casady guily upon one adultery count and not guilty on the other Casady desired the statutory time for sentence and was given until Monday morning at 10 oclock Judge Powers stated that they would appeal the case to the supreme court THE ATTORNEYS MAKE UP After the Casady matter had been settled Judge Powers called attention to i 4 the trouble that Mr Varian and himself had during the afternoon and made a statement of the matter saying that Mr Varian had applied to him a very vile epithet Mr Varian very frankly stated that he would withdraw the remarks which he had hastily made and that he did so sincerely Judge Powers also withdrew the remarks that he had made to Mr Varian aud sereinty again mounted her perch |
