Show Branufery Dispute: Judge Palmer Reverses Decision FARMINGTON - First he said he would, and then he wouldn't. SECOND DISTRICT Judge J. Duffy Palmer ruled earlier this week in favor of a temporary tem-porary restraining order that would have allowed 21 sophomore students involved in a boundary dispute to attend at-tend Bountiful High until the matter is resolved in court. A hearing on the boundary change was scheduled for Thursday at 10 a.m. BUT A FEW hours after ruling in favor of the students, Judge Palmer reversed his decision and said the students must enroll at Viewmont or wait for the results of the hearing. Judge Palmer said he withdrew the order based on further study that showed a -bond was not posted and that "irreparable damage" had not been proved by petitioning petition-ing parents of the students. THE CASE involves 21 of approximately 60 students who live within the boundary that was changed earlier this summer by the Davis Board of Education to extend the boundary for students to attend at-tend Viewmont High to include the area between 200 West and 800 East and from 400 North to 300 South. The suit charges that Davis School District officials based the boundary change on boundaries of the Bountiful Stake of the LDS Church. DISTRICT OFFICIALS, however, denied this allega-4 tion. Through their attorneys, they stated that although the boundary of the schools is' similar to that of the church stake, the boundary shift had nothing to do with religious considerations, grb |
