Show If 7 1 I ' RATIFICATION BY LEGISLATION. j I- l j j One of the most important decisions of the supreme court of I the United States, has just been rendered- declaring that states have , not the right to change the method of passing on federal constitu-, constitu-, , tional amendments, which must' be by legislative action and not pop , )j I alar vote. p This decision puts and end to-the contention that prohibition was not ratified because certain states failed to submit the question i'J to a referendum vote of the people. i The court takes a logical view, stating that the power to rat-' rat-' 1 ify. a federal amendment is derivpd from the federal constitution und a state has no authority to designate the means of ratification. This decision more firmly asserts that the federal power predominates predom-inates over state rights. At one time in our national history, a declaration decla-ration of that import, coming from the supreme court, would hate created a great uproar. Today it is the accepted rulo which is not X' questioned only by lawyers laboring to make a plausiblc'excuse for l their clients1 appearance in court |
