Show FID TOUT IS F01D IT GUILTY BY II JURY In the appeal case of Ogden City against Fred M. Tout, for alleged selling of intoxicating liquors on Sunday, Sun-day, April 18, 1915, D. W. McDonald, who was employed by the city at the time as a spotter, testified that he purchased of Mr. Tout, on tho day in question, twelve bottles o beer and a bottle of whiskey. Ho said that he carried the liquor away in a suitcase suit-case and turned It over to Sergeant H. C. Peterson. The witness said that ho was being paid $3 a day by tho city for his services, and that he would be paid his per diem and mileage mile-age from Los Angeles to testify in the case. On the other hand, the defendant testified that McDonald purchased no liquors, but that a suitcase previously previous-ly left at his place was turned over iu luujjuuttiu iii. tub ryqueat aau mat, if there were bottles of beer and whiskey whis-key in the case when Officer Peterson Peter-son received It, the contents had beon placed there by McDonald. Mr. Tout's testimony was corroborated by other witnesses. The following jury was empaneled to hear the case: L. P. NIolson, W. H. Farr, Henry Neuteboom, Albert Coop, Thomas J. Maddock, Alma D. Garner, Frank L. Anderson and W. J. Fowlos. Tho case was submitted to the jury at 12.30 and at 2:30 p. m. a verdict ver-dict of not guilty was given. In the meantime the jury went to lunch. Judge N. J. Harris, before whom the case was tried, being absent, the attorneys at-torneys in the case agreed that Judgo J. A. Howell should receive tho verdict. ver-dict. on . |
