Later u verdict in favor of the county was I rendprfd The attorney for the plaintiff contended con-tended that the county should be held I responsible for the account, as the 'district attorney had the right and discretionary power to secure the testimony tes-timony of an expert in tho case if he considered that it was necessary- On the other hand, the attorney for the county contended that the board was not legally bound by the actions of the district attorney, and that the paymcn' of the p-xpert fees was more a question for the state legislature to settle than the board of county com missionrr? t 3 o'clock this afternoon the court instructed the jury to render a ver diet of no cause of action. The decision settles the question in favor of the county as to whether the exnert on handwriting shall be paid the sum of $250 as witness fees (in the J. H. .Martin case. ! It is mld that there is a likelihood j of the matter being taken up before the state legislature with a view to I getting an aporopriation to pay the j fee and it is also said that an appeal may b taken to the supreme court. on |
