Show PROPERTY TRANSFER ORDERED BY COURT Salt Lake, Dec 31. Conformine with a writ of mandate Issued bv the supreme court. ludpe M L. Ritchie yesterday made findings of fact and conclusions of law in the divorce suit of Axel L Benson against Anna M Benson, refusing to award a decree of divorce and ordering the transfer of property held by Mrs. Benson in trust for her children to the T'tah Savings & Trust company as a third party. Benson sued for divorce December 10, chargin? cruelty Judge Ritchie found the evidence Insufficient t sup- I port the charge and held up the case In order to allow Benson to bring suit on other grounds Meanwhile Mrs Benson filed an answer and counter suit When the court re j fused to maki findings on the suit i begun by Benson, Mrs. Benson applied to the supreme court for a writ com j pelling 'he lower court to act This writ was issued after hearing and fudge Ritchie was given five davs In which to hand down a decision on the original suit In his decision yesterday Judge Ritchie holds that the evidence does not warrant a decree for the husband Further, he finds that Mrs. Benson Is an Improvident person and unfit to have charge of prbpertj deed", to her by her husband for the benefit nf the four minor children She 19 re-j strained from disposing of any of this property and Is ordered to transfer It to the Utah Savings & Trust company com-pany N'o disposition fs made of the children, chil-dren, they being Inmates of an orphanage or-phanage at present It is provided, however, that the question of their custody can be settled in supplemental supplement-al proceedings. |
