Show OUSTING OF CITY SCHOOL BOARD Another development In the effort of the city commission to oust the city board of education from the three rooms it occupies in the city hall came when a civil suit was filed in the municipal court by City Attorney Valentine Gideon, The suit asks that the three rooms be returned to the city, that the board be required to pay rent for the time occupied beyond be-yond the time limit given, and that the board be required to pay the costs of the suit instituted. An answer to the suit is expected from H. H Henders, attorney retained retain-ed by the board to handle the case. After that the case will be set for trial by Municipal Judge W. H, Reed-er. Reed-er. The complaint, which names Hyrum Pingree. George S Glen, W. H. Williams, Wil-liams, J. W Levedahl and Wade Johnson John-son as defendants, recites that the board occupied "as tenants at will" three rooms In the city hall and that the city commission served a written notice upon the board January 6 to vacate the rooms and turn them over to the mayor five days after service. The complaint further recites that the notice expired Tuesday, Jan. 13, and the board continues to occupy the rooms. In asking for restitution and payment pay-ment of rent, the complaint states that the rental value of the rooms is $100 a month Members of the board say they will right the case for the purpose of making mak-ing a test. They say that the board wishes to know whether the board is entitled to space In the city building |
