Show LAWYERS IN BIG WATER CASE IN SALT LAKE are arguing technicalities in the battle over waters of cade n river from thursdays standard in salt lake the attorneys for tha defendants in the contempt of court proceedings which are the outgrowth of the suit of the north ogden irrigation company against george A fuller et al are arguing before judge ratchie a motion for non suit in tho ccase on their ability to have the motion granted the attorneys baab their hope of clearing the defendants this is the second motion to be argued in an effort to aia the case on a technicality the first motion in the fuller geddes case being to quash the complaint on the ground that the relationship between me old north ogden irrigation company and the present north ogden irrigation company had not been shown the attorneys for the plaintiffs in the action then placed in evidence the quit claim deed resolutions of the board of directors and testimony of the officers of the company to show that the present company bad secured all the interests and rights of the old company the evidence firmly establishing the relationship between i the old and tho new company being introduced judge ratchie overruled the motion to dismiss the case but announced that the case would be tried as one to show cause why the defendants were not in contempt of court the attorneys for the defendants then made their motion to nonsuit non suit and the matter was set over until today in salt lake the six local attorneys appearing in the case went to salt lake this morning and one of them stated that he believed the arguments would not ba concluded today |
