Show DAMAGE SUIT FILED action against ralph E hoag for 5 as result of accident attorney N J harris filed a complaint in the district court today for ezra J wardle by susan his guardian ad autem against ralph E hoag in which damages are asked in the sum of it is alleged in the complaint that on june 11 1905 while young wardie was driving a horse hitched to a hay rake along the main road leading north from ogden and while turning to the left near the residence ot james martin at fair west and attempting to drive said horse and rake in at a gate the defendant came up in the rear running an at a rapid and furious rate ot speed and carelessly negligently and recklessly without regard to the rights or safety to the ran the automobile in ahead of the plaintiff and attempted to pasa ahead between the rake and the gate while attempting to pass the rake it is claimed that the defendant while close to the horse blew and sounded the whistle jorhom of the automobile very loud so auch so that the horse became frightened and ran away in the runaway the plaintiff allege that he was thrown with great force against a certain barbed wire fence and was dragged along said fence for some distance which resulted in his hands arms wrist and being severely torn and lacerated and that other parts of his body were cut and bruised the plaintiff claims that by reason of the accident he was confined to his bed for a long time and was prevented from doing or performing any work since the accident and that he Is permanently manent ly injured BO that he has lost the partial use of his hands arms wrists and fingers for which damages are asked tor in the sum of As a second baue of action it is claimed that rebecca wardle the widowed mother of the boy will be ae proved of his services during his minority for which are asked in the sum of thirty dollars Is asked for medical and surgical attendance and 17 for he damage to the harness and hay rake |
