Show PARLEY 18 discharged complaint in the case was improper ly drawn in discharging D K parley who runs the riverside saloon and who was charged with having disturbed tho peace judge murphy called attention to the fact that the charge had not been properly drawn and that it should have been on the grounds of leeping a disorderly house which charge he said he thought would bear investigation the complaining witness geo huff who resides in the building in which the riverside saloon Is located testified that on he night of august ath he had been awakened by the noise that was being made in the rear of the saloon he ashod the people to desist and then returned to bed in a short while parley called to him and asked him what he was hollering about using vile language to the witness huff said that parley told him that it he complained to the police he farley would tako a shot at him mr huff stated that the saloon was the scene of nightly disturbances which had aroused the feelings of the neighbors to such an extent that it had been necessary to appeal to the police on several occasions several witnesses corroborated buffs huffs statements and the prosecution rested on tho stand farley denied all that huff had testified to and stated that be was always perfectly kind and gentle never got excited anden general was particular about people liepp ing quiet in hla place farlena Far leya discharge was ordered on motion of attorney lessenger for tha defense on the ground that the complaint was not properly drawn |
