Show FIVE WITNESSES TESTIFY AS TO PLOW plaintiffs in water consumers struggle describe amount of its water available for irrigation prom thursdays Sl anJard tho plaintiffs in the water consumers struggle for the use of the water flowing down ogden river examined five witnesses wednesday afternoon the entire testimony centered around the amount of water flowing down ogden river that is available for irrigating purposes and how much the several canals are entitled to use of the whole amount in the river joseph bidwell of north ogden took the witness stand after the water commissioner had produced and given his report of the amount of water flowing in the lynne plain city and north ogden canals he testified that be had been sent by the north ogden irrigation company to north fork in ogden valley to ascertain how much water was being diverted by the eden consumers from that stream and to report on condition of the crops ln that section mr bidwell stated that the wheat w as nearly all and those fields that were not ripe had sum clent water he also stated that the other crops were in the same condition as the wheat all thriving well witness also stated that during the investigation of river he came across an obstruction in the stream which he immediately proceeded to tear out this obstruction transpired to bo a dam put there by the farmers of eden some heated words passed between the two parties but no settlement of the trouble was then effected george elliot chit engineer at the power house was the next witness he from records kept by men on duty at the dam in ogden canyon showed how much water was used by his corn pany at the power plant this water witness stated was turned into ogden river again at a point below the head gate of the north ogden canal according to the witness there are but thre methods 0 using the entire flow of tha canyon stream that of conveying a part through the pipe line chaa of conveying a part in the city water line and letting the remainder run over the dam he also stated that on august 1 second test were running over the head gate of the dam W jenne one 0 the watchers at the power dam was called he corroborated the statements of engineer elliot i J E taylor of testified from memory when the canals south of the north bogde n canal were taken out this testimony was taken to who hadtke prior right it is probable that this case will become of state importance 4 as the same conditions alst wherever water mistaken out othe same river by consumers living jn different valleys one above the it will specify fhe rights of each and will bs the means ot causing a more accurate measurement |
